Who Needs an Authorised Representative?
An Authorised Representative is necessary for a company that falls into the "producer" category under the PPWR and does not have an establishment in the Member State where it places packaging on the market. Whether that is you depends on how you sell.
An Authorised Representative is mandatory if you are a non-EU company that:
- Sells directly to consumers or end-users in the EU (B2C), for example via your own website or marketplaces like Amazon. As the first entity placing the packaging on that market, you are the producer and must appoint an AR in each Member State where you sell and are not established. The same applies to EU-based distance sellers supplying consumers in Member States where they have no establishment.
- Distributes through your own EU entity. If you have set up a subsidiary in a Member State and sell through it, that entity carries the producer obligations there and needs its own EPR registration. We help you keep those fragmented national obligations under control.
Selling to a business (B2B) in the EU? If you sell your packaged goods to a local distributor or importer, they are generally the "producer" for EPR purposes and are responsible for registration and AR appointment. Our AR service is not required in this case, though we can still help you verify your supply chain's compliance status.
⚠️ Important: when you may NOT need an AR. If your business model involves selling your packaged products to an established company (importer or distributor) within the EU, that EU-based entity typically becomes the "producer" and is responsible for EPR and AR obligations. In this B2B scenario, you are generally not required to appoint an AR. You would, however, need to provide that partner with the technical documentation and Declarations of Conformity for your packaging, which is exactly what the TaxSync platform produces.
Two Types of Authorised Representatives Under PPWR
The PPWR introduces two distinct roles, and we help you navigate both.
National EPR Authorised Representative
- Purpose: Fulfil Extended Producer Responsibility (EPR) obligations in a specific country.
- Scope: National. Required in each Member State where you are not established and are required to register for EPR.
- Appointed By: The "producer" (importer/distributor).
EU-Wide Authorised Representative
- Purpose: Act on behalf of the manufacturer for specific tasks related to PPWR conformity, such as keeping technical documentation and communicating with authorities.
- Scope: EU-wide, but appointment is often voluntary for EU manufacturers unless required by a Member State.
- Appointed By: The "manufacturer" (brand owner).
Which AR applies to you? The National EPR AR is the one that will be mandatory for most of our non-EU clients, as it directly fulfils the compliance requirement for direct sales (B2C) to consumers in that country.
